Justice For All

Common Intention and Common Object

Understand the distinction between common intention and common object in group criminal liability.

Indian criminal law recognises forms of group liability where the statutory requirements for common intention or common object are established.

Common Intention

Common intention concerns a shared intention and participation in action taken in furtherance of that intention. Its existence is assessed from the facts and circumstances.

Common Object

Common object relates to the legally defined object of an unlawful assembly and the statutory conditions for attributing liability to its members. It is conceptually distinct from common intention.
